For the songwriters
What typically happens
once a song is licensed?
Depends on the clients need to license it. It may be used (as is,
just how we have recorded it, not redone by another artist) an indie
film, tv, video, video game... Its licensed for a preset amount;
points on the project, flat one time fee for use in there project.
As well as its public use will hopefully also generate royalties
collected by ASCAP/BMI, which ever you are or end up being
represented by.
Can the song be used elsewhere outside of the licensing?
Most licenses are exclusive for a pre-determined amount of time,
each license differs. So the song may be held for a year, therefore
you want the agreement to make sure you are compensated for that
exclusiveness. Licenses may be issued to a small indie film that
generates zero monies, in that case there would be a NON-Exclusive
license with them and we would actively seek other placements. The
indie film would hopefully generate ASCAP/BMI royalties. If the film
takes off, the license would possibly need to become exclusive.
How long would the licensing be in effect for?Depends
on the licensing agreement. 6months, 1 year, 5 years... But if they
want it exclusive for an extended period of time, you make sure you
are compensated for it.
What is a typical publishing/song plugger deal like compare to
Eclectica Recordings Publishing?Check out HUMTOO. They have
many songwriters signed on and license music to many clients. They
hold an exclusive rights to your songs for them to shop for 5 years
and they take 100% of any publishers royalties. We do not ask for an
exclusive right unless we get it placed, allowing you to do whatever
you want with the song on your own. Our agreement also is for a 50%
share of the publisher royalties, with the other 50% remaining with
the writer.
What's the overall
details of how this works?
Here is the basic information
on what our contract covers. Joining Eclectica Recordings
Publishing (ERP) places your songs in our data base along with other
works produced by us. This catalog consists of a wide range of styles
and musical genders. The online catalog will be available on our
site for industry A&R, music supervisors for film and TV, producers
looking for songs for artist to cover, and any other placement
opportunities. At the same time we will be actively seeking
opportunities to submit the material to 3rd parties in need of music
for their use (licensing).
Only titles in which I have produced will be handled by ERP
(Eclectica Recordings Publishing). There is no cost to you for
any of this. This is a standard publishing deal, you make money when
and if a song of your own is licensed.
